General terms and conditions of the contract between Töls and the user:
The user declares that they are of legal age and have the necessary legal capacity to contract the services offered by Töls, also stating that they accept being bound by this agreement and fully understand and agree with the conditions outlined below concerning the use of the websites and the contracting of the services offered.
In the case of contracts made by minors, parental or guardian authorization is required to enjoy the contracted service. The user agrees to use the services and content on our Website in accordance with the Law and the general and specific terms and conditions of the services offered by Töls at any given time, and must refrain from using them to:
a) Disclose their username and password to unauthorized third parties, immediately notifying Töls if access is gained by an unauthorized user.
b) Engage in illegal activities, activities contrary to good faith, customs, morality, or public order.
c) Engage in activities that violate intellectual and industrial property regulations or any other applicable legal norms.
d) Reproduce, duplicate, sell, or exploit any content from the Website for commercial purposes.
e) Distribute racist, xenophobic, pornographic content, or content that promotes terrorism and/or violates human rights.
Upon registering on Töls, the User will receive a username and password chosen by the User. Töls is not responsible for the misuse of the passwords by the User as a registered customer when purchasing products on Töls. It is the User’s responsibility to properly safeguard the keys and passwords provided for accessing as a registered customer, preventing misuse or access by third parties.
The user declares that all the information provided during registration is true, complete, and accurate, and in accordance with Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data. The person registering expressly authorizes Töls to include the personal data from the registration form into an automated activity register, as necessary for the proper provision of services, such as:
a) Placing orders for the products offered on the Töls websites.
b) Verifying credit cards and other types of payment cards.
c) Conducting statistical analysis.
d) Complying with Töls’ accounting, billing, and auditing requirements.
The data controller is the company GAGER SPORT S.L. (CIF B66962424, located at Calle Vergós 53 Entslo 2ª 08017 Barcelona, email: sxemindset@gmail.com) for the purpose of exercising the rights of access, rectification, cancellation, and opposition provided for by law. The customer expressly authorizes the communication of such data to third parties when necessary for the proper provision of contracted services, in compliance with the applicable legislation.
The user gives their express consent to receive electronic communications with advertising and commercial updates from Töls regarding the products and services it markets.
The prices shown on the screen include VAT and any other applicable taxes or fees.
The user accepts that the applicable legislation for the operation of this service is Spanish law. The courts of the user’s domicile will be competent to resolve any disputes arising from the interpretation or application of these Terms.
The transmission of data made by the user through the Töls websites, or the information provided by the user, is protected by the latest electronic security techniques. Additionally, the data provided and stored in our databases are also protected by security systems that prevent unauthorized access. Töls makes its best efforts to ensure that its security systems are up-to-date.
The maximum delivery time for the product is specified in each offer, which will not exceed 30 calendar days. If, due to force majeure, Töls cannot meet the specified delivery time, it will promptly inform the user of the situation.
a) The user must verify that the received goods correspond to the products they ordered and that they are in perfect condition. If any external or internal damage is noted, the user must report the issue via our contact form within 48 hours of receiving the shipment.

The user is responsible for providing correct details, especially the delivery address for orders. Töls is not responsible for any problems or costs arising from incorrect details.
Cancellations are not allowed once payment is made.
The User has fifteen (15) calendar days from the receipt of the order to exercise their right of withdrawal and return a product they are not satisfied with, recovering the amount of the product, including delivery costs. The product must be returned with the invoice. For the security of the User, we recommend using a certified or insured shipping service, which can be arranged with the transport company for the value of the product. Return costs are the User’s responsibility, unless the product was sent in error or is damaged or defective, in which case the return shipping costs will be borne by Töls. However, in such cases, the user must only return the product using the most economical shipping method, which will be indicated by Töls.
The User will be responsible for the depreciation of the product due to mishandling, beyond what is necessary to determine the nature, characteristics, and operation of the goods. In case of improper handling by the User, and after an assessment by Töls’ technicians to determine the loss in value, an offer will be made to the customer. If the customer accepts the offer terms, the return will be accepted, and Töls will process a refund for the agreed amount. If the customer does not accept the offer, they must take responsibility for the product and its collection from Töls’ warehouses.
For its nature, returns will not be accepted for products that have been unsealed and show clear signs of having been used beyond the reasonable use to verify their proper functioning, and therefore cannot be returned. Returned products must be in the same condition in which they were sent, with all components intact, without modifications or alterations, and preferably in their original packaging. Töls understands that the original packaging may have been removed for inspection but will not accept returns without the seals, internal packaging, and fastenings.

Once we receive the product and confirm it meets the return requirements, Töls will process the refund to the payment card used for the purchase or through the user’s PayPal account (as applicable) within a maximum of fourteen (14) calendar days from the date the user confirms the return. In case of undue delay in the refund, the user is entitled to request double the amount owed from Töls, in addition to their right to compensation for other damages.
If any clause in these general conditions is declared fully or partially null or ineffective, such nullity or ineffectiveness will only affect the respective provision, and the rest of the terms will remain in effect.
